Consumer Replied: Reputable Dealers whether they claim a deposit is non-refundable or not always refund the money if the deal is not finalized even if it's a new car factory ordered out of a Dealer's allocation. They just sell it to someone else or Dealer trade it. In this case the car in question is not even a new car factory ordered at the buyer's initiative, but a three year old used car and the Dealer is in no way financially harmed if the deal is not finalized. It is a universal practice across the automotive industry to refund a deposit if a deal is not struck and has been since I started buying cars in the 1970s. This Dealer attempts the ploy of likening this deal to a real estate transaction and the money put up to hold the car as "earnest money" as in a real estate sale. Of course, this is no real estate transaction. This Dealer asserts If the buyer does not hold up his end of the bargain he forfeits his ill-named "earnest money" as one might in a real estate transaction..This is just another self serving selling strategy, a sharp business practice with a bad odor, designed to be a win-win proposition for the Dealer. It was/is an attempt to coerce the sale under the fear of losing what is deemed in the most truly outrageous fashion as "earnest money." The Dealer uses the cover story that they never hold cars for potential buyers to give them an opportunity to get to the dealer to have a visual inspection, take a test drive, or even have a third party inspection if deemed necessary to see if the car is as the Dealer represented it. No, this Dealer claims they only sell cars. It would be interesting to investigate to see how long it's been since they instituted this sales strategy. In this case one business day passed before I reached the Dealership from out of state to see the car. The sales policy is little more than thievery, a veritable extortion, done under the cloak of legality so the Dealer can claim this is all above board, entirely legal, and they have done nothing wrong. This is not a consumer friendly Dealership and this sales strategy runs counter to Fair Trade standards and practices. In the long run this only comes back to bite the Dealer as the word gets out through social media and through word of mouth about their sharp business practices and it ends up driving potential clientele away. In my case my trade vehicle was damaged en route to the Dealership from out of state. It was a tight deal meant to be a cash transaction. I wanted the title and would have to have taken a lien to make the purchase at a higher trade difference which I did not want to do. In this interest rate environment the interest rate on the loan would prove onerous. The Dealer could have just refunded my money and let it go at that. Small Claims Courts have looked with askance at car dealers that have kept deposits in this case dubbed "earnest money" leaving their buyers with nothing of value. That's where this is all headed.
