Willy A. Replied: Dear Tony S.,I am sorry you feel this way about our staff and management team. You did take the vehicle for a 30 minute test drive the day of the delivery. It also appeared that you were happy when you left with the vehicle and the entire transaction. That same weekend you drove the vehicle for hundreds of miles and on Monday morning you came back to return it. You advised us you spoke with many friends in the auto business and they said they could have made a better deal and it would be ok to return the vehicle back to the dealership. Our management staff met with you and explained this is not possible after you've driven it for several hundred miles. Then you stated that you had a medical issue where your arm bothered you when it was hanging outside the driver's side window. You said you can produce a note. At that point the sales management team decided that they would allow you to exchange this vehicle for any other vehicle we had in stock. You spent some time looking around but decided not to exchange the vehicle for anything else. We gave you the opportunity to chose another vehicle but you chose not too, not to mention that the deal for that particular model was well below market. The dealer also spent over $800 as a goodwill gesture to replace the front bumper because when we gave you the vehicle with front and rear license plates, per NJ state law. Since you are a Jersey City Police officer you felt that you did not need the front plate and wanted a new front bumper. We felt we did everything to try to satisfy your needs except unwind the deal when the car had been driven all weekend. Bob Berg is a true professional. Bob saw us coming and he got up from his desk and opened the door to let us in. And he didn't tell us to walk out and come back in. Youre both certainly aware of how your wife spoke with several members of our staff and the Customer Assistance Center representative at Mercedes-Benz USA. We have done our best to address the issue with your vehicle that was a result of a large milk spill inside your vehicle. Benzel-Busch must adhere to the policies and procedures of your insurance company when carrying out repairs that are paid for by them. With reference to your claim, Benzel-Busch requested seat cover replacement approval from your insurance company during the initial portion of the repairs. Your Insurance company initially denied our request and instructed us to contact Serve Pro to clean the interior of your vehicle using chemical products. We refused to do this and only after several conversations with the insurance appraiser were we finally able to convince your insurance company to agree to replace the required parts that included the seat cover to eliminate the odor inside your vehicle. While we understand that youre rightfully upset about the circumstances surrounding this matter no one at Benzel-Busch has ever attacked or verbally abused your wife! Our loaner vehicle that was provided to your wife free of charge was returned to our facility damaged. We immediately notified your wife and as per our Loaner Agreement with her we charged her for the required repairs at our cost. With regards to your deductible were sorry but legally we cannot negotiate with you regarding your insurance deductible as that would be clearly an act of insurance fraud. Benzel-Busch and their staff are not thieves and run a totally transparent Service and Collison Center operation. In closing your request for compensation for down time is not reasonable as this issue was not a product related warranty failure. Benzel-Busch did however provide your wife with a new Mercedes-Benz loaner vehicle for the entire time your vehicle was being repaired in an effort to minimize the inconvenience that was caused by this very unfortunate situation.
